General Terms and Conditions of Sale


Article 1 – Purpose

These General Terms and Conditions of Sale are intended, firstly, to inform any purchaser of the terms and conditions under which NATAQUASHOP sells and delivers the products ordered and, secondly, to define the rights and obligations of the parties in connection with the sale of products by NATAQUASHOP to its customers.
These Terms and Conditions apply, without restriction or reservation, to all sales of products offered by NATAQUASHOP on its website, www.nataquashop.com.
Consequently, placing an order for any product offered for sale on the NATAQUASHOP website constitutes the customer's full and unconditional acceptance of these General Terms and Conditions of Sale, which the customer acknowledges having read before placing an order.
NATAQUASHOP reserves the right to amend these General Terms and Conditions of Sale at any time.


Article 2 – Prices

The selling prices of products displayed on the NATAQUASHOP website are expressed in euros and are those applicable at the time the customer places the order.
Prices do not include packaging and shipping costs, which are charged in addition to the purchase price of the products. These costs will appear on the invoice before the customer validates the order.
NATAQUASHOP reserves the right to modify product prices at any time.


Article 3 – Product Characteristics

In accordance with Article L.111-1 of the French Consumer Code, customers may consult the essential characteristics of the product(s) they wish to purchase on the NATAQUASHOP website before placing an order.
Customers may select one or more products from the various categories available on the website.
Offers presented by NATAQUASHOP are valid while stocks last.
For products that are not held in NATAQUASHOP's warehouses, offers remain subject to availability from suppliers, whose stock levels may change at any time.
The photographs, graphics, and product descriptions displayed on the website are provided for information purposes only and are not contractually binding upon NATAQUASHOP.
Should a supplier modify a product, the graphical representation of that product shall not engage the liability of NATAQUASHOP nor affect the validity of the sale.


Article 4 – Orders

Placing an order implies full and unconditional acceptance of these General Terms and Conditions of Sale.
Once the customer has validated the order, they are deemed to have knowingly accepted, without reservation:
  • these General Terms and Conditions of Sale;
  • the prices;
  • the quantities;
  • the specifications of the products ordered.
The customer's order shall be confirmed by NATAQUASHOP via email.
The sale shall only become final once NATAQUASHOP has sent the order confirmation email and has received full payment of the purchase price.
Please note: the order confirmation email may be delivered to the customer's spam or junk mail folder.
NATAQUASHOP recommends that customers retain a copy of the order confirmation, either in paper or electronic format.
Orders placed from Friday afternoon through the weekend are processed on Monday. The 24-hour preparation period therefore runs from Monday morning to Friday midday.


Article 5 – Payment

Payment must be made in full when the customer places the online order.
Amounts paid may not be considered as deposits or advance payments.
All orders are payable in euros.
The following payment methods are accepted:

Accepted bank cards include:
  • Carte Bleue
  • Visa
  • Mastercard
The customer guarantees that they are fully authorized to use the selected payment method when validating the order.
NATAQUASHOP reserves the right to suspend or cancel any order and/or delivery, regardless of its stage of processing, in the event of:
  • non-payment of any amount due by the customer;
  • payment incidents;
  • fraud or attempted fraud relating to the use of the NATAQUASHOP website.
As part of its fraud prevention procedures, information relating to the customer's order may be transmitted to third parties for verification purposes.

Article 6 – Delivery and Receipt of Goods

Products shall be delivered to the name and address provided by the customer when placing the order.
Invoices may be downloaded from the customer's account.
Failure to comply with the procedures set out below may result in the customer's claim being rejected.
Upon delivery, the customer must inspect the condition of the order together with the carrier before submitting any claim to our Customer Service Department.


Article 7 – General Delivery Terms

Products shall be delivered to the address specified by the customer when placing the order.
If the customer or recipient notices any damage, missing items, or discrepancies concerning either the packaging or the contents of the parcel, they must notify NATAQUASHOP by email within 48 hours of receiving the order. Failing this, the claim may be rejected.
In accordance with the French Hamon Consumer Law of 17 March 2014, applicable since 14 June 2014, NATAQUASHOP reserves a maximum period of 30 days from order confirmation to deliver the order.
Should this period be exceeded, the customer may either cancel or maintain the order.


Article 8 – Delivery via Mondial Relay

The customer or recipient shall collect the order from the Mondial Relay collection point selected on www.nataquashop.com at the time of purchase.
The customer will be notified by email or SMS once the parcel is available and has 8 days to collect it.
If the parcel is not collected within this period, it will be returned to the sender. New shipping charges will then be payable before the order can be reshipped.
The customer or recipient must inspect the parcel in the presence of the delivery agent.
If any damage or missing items are identified, the parcel must be refused and the incident reported to NATAQUASHOP by email within 48 hours of delivery. Otherwise, the claim may be rejected.


Article 9 – Delivery via Colissimo

Delivery is made by the postal service to the address provided by the customer.
If the customer is absent, a delivery notice will be left, allowing collection of the parcel from the nearest post office within 15 days.
After this period, the parcel will be returned to the sender. Additional shipping costs will be required to resend the order.
Upon delivery, the customer or recipient must inspect both the packaging and the contents in the presence of the postal employee or delivery driver.
If any damage or missing items are found, the customer must:
  • follow the official Colissimo claims procedure, including reporting the damage and refusing the parcel by requesting an official damage report (Form 170);
  • notify NATAQUASHOP by email within 48 hours of delivery.
Failure to comply with these procedures may result in the claim being rejected.
Since the COVID-19 pandemic, Colissimo reserves the right to deliver parcels directly into mailboxes without requiring the recipient's signature.


Article 10 – Delivery via DPD

Orders are delivered to the customer's address by the carrier selected by NATAQUASHOP.
The recipient must electronically sign a proof of delivery.
If the recipient is absent, a delivery notice will allow them to contact the carrier and arrange another delivery date.
The customer has 10 days to claim the parcel. After this period, the parcel will be returned to the sender and new shipping charges will apply before reshipment.
The customer must inspect both the parcel and the number of packages delivered in the presence of the driver.
If any damage or missing items are identified, the parcel must be refused and NATAQUASHOP notified by email within 30 working days of receipt.

Article 11 – Delivery via Ici Relais

Orders are delivered to the Ici Relais collection point selected during checkout.
Customers are notified by email or SMS once the parcel becomes available and have 10 days to collect it.
After this period, the parcel is returned to the sender, and additional shipping charges will apply before reshipment.
Customers must inspect the parcel in the presence of the delivery agent.
If damage or missing items are observed, the parcel must be refused and NATAQUASHOP informed by email within 48 hours of delivery.

Article 12 – Delivery via Chronopost

Orders are delivered to the address provided by the customer.
Saturday delivery is available subject to an additional charge payable to NATAQUASHOP. Orders must be placed before 1:00 p.m.
If the customer is absent, a delivery notice will allow collection of the parcel from either the nearest post office or a Chronopost collection point within 15 days.
After this period, the parcel will be returned to the sender, and new shipping charges will apply before reshipment.
The customer must inspect both the packaging and its contents in the presence of the postal employee or delivery driver.
If damage or missing items are discovered, the customer must:
  • follow the official Chronopost claims procedure, including refusing the parcel and requesting an official damage report (Form 170);
  • notify NATAQUASHOP by email within 48 working hours of delivery.
Failure to do so may result in the claim being rejected.


Article 13 – Delivery via UPS

Orders are delivered by UPS to the address specified by the customer.
If the customer is absent, UPS will leave a delivery notice allowing the customer either to collect the parcel from a collection point or arrange a new delivery within 10 days.
After this period, the parcel will be returned to the sender. New shipping charges will apply before the parcel can be resent.
The customer must inspect the packaging and contents in the presence of the UPS representative or delivery driver.
If any damage or missing items are found, the customer must:
  • follow the official UPS claims procedure, including refusing the parcel where appropriate;
  • notify NATAQUASHOP by email within 48 hours of delivery.

Failure to comply with these requirements may result in the claim being rejected.



Article 14 – Order Processing Time

The dispatch time depends on the availability of the ordered products and begins once the order has been confirmed (upon receipt of payment).
This period corresponds to the time required to process and prepare the order for shipment.
For items that are in stock, the dispatch time is 24 hours from order confirmation.
The delivery time begins once the parcel has left our warehouse. It corresponds to the time required by the selected carrier to deliver the parcel to the delivery address provided during checkout.
Delivery times vary depending on the shipping method selected by the customer.


Article 15 – Delivery Times

Delivery times range from 48 hours to 30 business days, depending on the products ordered and from the date payment is received.
NATAQUASHOP undertakes to indicate an estimated delivery date or delivery window at the time the order is placed.
Any delay beyond the estimated delivery period shall not entitle the customer to claim compensation, withhold payment, or cancel the order.
In accordance with Article L.121-20 of the French Consumer Code, products shall, in any event, be delivered within a maximum period of 30 days following the day after the customer places the order, subject to full payment.
If delivery has not taken place within this period, the customer may cancel the order.
Any sums paid will be refunded without undue delay, excluding any additional compensation.
Cancellation requests must be submitted in writing by email using the contact details provided on the NATAQUASHOP website.
NATAQUASHOP will then initiate an investigation with the carrier concerned.
Carrier investigations may take up to 30 business days.
If the parcel is located during this investigation period, the customer may choose either:
  • to have the parcel immediately redelivered to the original delivery address; or
  • to receive a refund for the undelivered products.
If the parcel cannot be located after the investigation has been completed, the customer may choose either:
  • a full refund for the undelivered products; or
  • a replacement shipment at no additional cost.


Article 16 – Order Cancellation Before Dispatch

If the customer cancels an order before it has been dispatched, NATAQUASHOP will refund:
  • the full purchase price of the product(s); and
  • the delivery charges,
using the same payment method originally used to place the order.


Article 17 – Returns

17.1 Return Request

Products must be returned to NATAQUASHOP in perfect resale condition, in their original condition, including all packaging, accessories, manuals and documentation, properly sealed where applicable, and accompanied by the signed return form.
Customers have 14 calendar days from receipt of the goods to notify NATAQUASHOP in writing of their intention to return an item.
To request a return:
  1. Log in to your customer account.
  2. Open the "My Orders" section.
  3. Select the relevant order.
  4. Choose the item to be returned.
  5. Click "Request a Return."
A return form will then be sent by email. This form must be printed and enclosed with the returned parcel.

Return shipping costs remain the responsibility of the customer, regardless of the reason for the return.


17.2 Return Processing

The customer has 14 days from the return request to ship the parcel.
Once received, the returned item will be inspected by our Customer Service team to verify its condition.
The customer will then receive an email confirming whether the return has been accepted.
If the returned goods are received within the required time limit, NATAQUASHOP will refund the purchase price in the form of store credit valid for one year, unless the customer specifically requests reimbursement to the original payment card.
If an order initially qualified for free shipping because its value exceeded €69.90, and the return reduces the order value below this threshold, the original shipping costs will be deducted from the refund or store credit.
If the customer requests an exchange during the 14-day withdrawal period, NATAQUASHOP will cover the cost of shipping the replacement item only if the original order was delivered by Colissimo or Ici Relais.
If an item becomes unavailable after the order has been placed, both the purchase price and the shipping charges relating to that item will be credited.

Club Shop Personalised Products

Please note: products ordered through a Club Shop that have been personalised cannot be returned or exchanged.
Personalisation options are determined exclusively by the club. Individual members cannot request modifications.


17.3 Returns Submitted After the Deadline

Any item returned more than 14 days after the return request has been made will not be refunded or exchanged.
If the customer wishes to recover the returned item, additional shipping charges will be payable.


17.4 Size Disclaimer

NATAQUASHOP cannot be held responsible if the selected size does not fit.
Size charts are provided for guidance only and do not constitute a guarantee of fit.


17.5 General Conditions

NATAQUASHOP does not accept parcels sent carriage forward (cash on delivery).
The customer bears all risks associated with returning products.
Failure to comply with the return procedure or the applicable deadlines will prevent the customer from making any claim regarding missing items, non-conformity, or visible defects.


17.6 Defective Products

If a customer receives a defective product, they must:
  • submit a return request using the standard return procedure;
  • notify NATAQUASHOP within 30 days of receipt;
  • provide photographs of the defect by email.
If the supplier accepts the product as defective, a return authorization will be issued and must accompany the returned parcel.
Upon receipt, NATAQUASHOP will either:
  • send an identical replacement product; or
  • issue store credit valid for one year if a replacement is unavailable.
If a customer returns a product without prior approval and the defect claim is rejected, the customer will be required to pay the shipping costs for the item to be sent back.
For defective product claims, return shipping costs remain the responsibility of the customer.
Opened CDs and DVDs cannot be returned, in accordance with Article L.221-28 of the French Consumer Code.


Article 18 – Right of Withdrawal

18.1 Principle and Time Limit

In accordance with Articles L.221-18 et seq. of the French Consumer Code, customers have 14 calendar days to exercise their right of withdrawal without giving any reason.
For the sale of goods, the withdrawal period begins on the day following receipt of the goods by the customer or a designated third party.
For service contracts, the withdrawal period begins on the day following the conclusion of the contract.


18.2 Exercising the Right of Withdrawal

To exercise the right of withdrawal, the customer must notify NATAQUASHOP before the expiry of the withdrawal period by sending either:
  • the standard withdrawal form attached to these Terms and Conditions; or
  • any other clear and unambiguous statement expressing the decision to withdraw.

18.3 Effects of Withdrawal

If the customer exercises the right of withdrawal, NATAQUASHOP will reimburse all payments received, including the standard delivery costs (excluding any additional costs resulting from the customer's choice of a premium delivery service).
The refund will be made without undue delay and no later than 14 days from the date NATAQUASHOP is informed of the withdrawal.
Refunds will be made using the same payment method used for the original transaction unless the customer expressly agrees otherwise.


18.4 Returning the Goods

The customer must return the goods without undue delay and no later than 14 days after notifying NATAQUASHOP of the withdrawal.
The direct cost of returning the goods is borne by the customer.

The customer may be held liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.


18.5 Exceptions to the Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to:
  • goods made to the customer's specifications or clearly personalised;
  • goods liable to deteriorate or expire rapidly;
  • goods which, after delivery, have been inseparably mixed with other items due to their nature;
  • sealed goods that have been unsealed after delivery and cannot be returned for reasons of health protection or hygiene.


Article 19 – Retention of Title

NATAQUASHOP shall retain full ownership of the products sold until full payment of the purchase price, including all applicable taxes, fees and ancillary charges, has been received.


Article 20 – Liability

NATAQUASHOP shall not be held liable for any failure to perform its contractual obligations resulting from stock shortages, product unavailability, force majeure events, disruptions, or total or partial strikes affecting postal services, transport providers and/or telecommunications services.
NATAQUASHOP shall not be liable for any indirect, incidental or consequential damages arising from the purchase or use of its products.
NATAQUASHOP shall not be responsible for any loss of data or files. Customers are solely responsible for making any necessary backups relating to their orders.
The NATAQUASHOP website may contain information supplied by third parties as well as links to external websites.
NATAQUASHOP shall not be held liable for any damages resulting from the use of, access to, or inability to use such third-party information or external websites.


Article 21 – Partial Invalidity

Should one or more provisions of these General Terms and Conditions be declared invalid or unenforceable by law, regulation, or a final decision of a competent court, the remaining provisions shall remain fully valid and enforceable.


Article 22 – No Waiver

The failure of either party to enforce any provision of these General Terms and Conditions at any time shall not be construed as a waiver of its right to enforce that provision or any other provision in the future.


Article 23 – Personal Data Protection

The personal information collected by NATAQUASHOP when processing customer orders is necessary for the management and fulfilment of those orders by NATAQUASHOP and its commercial partners.
In accordance with the French Data Protection Act (Law No. 78-17 of 6 January 1978, as amended) and the applicable General Data Protection Regulation (GDPR), customers have the right to access, rectify, object to, restrict, erase or request the portability of their personal data.
These rights may be exercised by contacting NATAQUASHOP using the contact details provided on the website.
Where the customer has expressly given consent, NATAQUASHOP may send commercial offers or marketing communications, either directly or on behalf of selected partners.
Customers may withdraw their consent and unsubscribe from such communications at any time by contacting NATAQUASHOP by email or post.


Article 24 – Consumer Mediation

Consumer Dispute Resolution

In accordance with the provisions of the French Consumer Code, any customer involved in a dispute with MLCN SPORTS – NATAQUASHOP may refer the matter, free of charge, to the designated consumer mediator.

Before referring the matter to the mediator, the customer must first attempt to resolve the dispute directly with NATAQUASHOP's Customer Service Department.
The mediation request may be submitted online, by post or by email, together with all relevant supporting documents, including any previous correspondence between the parties.
The mediator will first determine whether the request is admissible and, where appropriate, will propose an amicable solution.
The mediation process is confidential and free of charge for consumers and is conducted in accordance with the applicable legal requirements.


Article 25 – UDI Number (Unique Syderep Identifier)

In accordance with Article 19 of French Law No. 2004-575 of 21 June 2004 on Confidence in the Digital Economy, producers operating a website are required to communicate their Unique Identifier (IDU).
